Step 2: Filing Form TM-A
After preparation, this form is submitted online. From the day of filing, your trademark is entitled to the ™ symbol.
Step 3: Government Examination
This step involves checking whether any objections are raised by the Examiner, like the mark's commonality or similarity to another trademark.
Step 4: Replying to Objections
We write a well-substantiated reply to the Examiner's objections and back it up with case laws to substantiate your unique trademark.
Step 5: Show-Cause Hearing
If the Examiner is unsatisfied with your objections, then the matter goes to a show-cause hearing before the Registrar.
Step 6: Publication in Trademark Journal
Once accepted, the mark is advertised in the Trademark Journal for 4 months. This allows the public to "Oppose" the registration if they feel it violates their rights.
Step 7: Registration
If no opposition is received, the Trademark Registration Certificate is issued. It is valid for 10 years and can be renewed indefinitely.
